1. Acceptance of these terms

By accessing or using this website and its tools, you agree to these Terms of Use. If you do not agree, please do not use the site. If you use the tools on behalf of an organisation, you confirm you are authorised to accept these terms for it.

2. Who we are

This site is operated by JK & Associates ("JK", "we", "us"), an aviation management consultancy based in Nairobi, Kenya. You can reach us at info@aviationhubkenya.org.

3. Purpose — and no professional advice

All the tools on this site — the venture tools (Venture Control Room, KCAA Certification Navigator, Greenfield Venture Builder, Corporate Structure Designer, Organogram & Postholder Planner) and the operating-carrier tools (Airline Health Scorecard, CASK Benchmarking Calculator, Operating Model Canvas, Fuel Contract Optimizer Lite, Training Needs Analysis, MRO & Technical Readiness Diagnostic, 48-Hour Data Request) — together with the Kenya Aviation Regulatory Index, are provided as free, general, educational orientation tools. They are not professional, financial, legal, accounting, tax, safety, airworthiness or regulatory advice, and using them does not create a consultant–client relationship.

• Outputs are indicative only and depend entirely on the figures and answers you enter, which are self-reported and not verified by us.
• Benchmarks and industry figures are drawn from third-party sources (such as AFRAA and IATA) for context and may be incomplete, dated or not directly comparable to your operation.
• Regulatory content is not a substitute for the gazetted instrument. We are not affiliated with or endorsed by the Kenya Civil Aviation Authority or any regulator. Regulations are amended, revoked and replaced; citations we mark unconfirmed could not be verified against the public gazette record at the stated date. Verify every citation against the current instrument and the Authority's advisory circulars before you rely on it or submit anything.
• Capital, structuring and readiness outputs are planning aids, not commitments. Capital ranges, debt-service and DSCR figures, look-through ownership percentages, lead times, critical-path dates and any readiness score are modelled from your own assumptions. They are not a valuation, a funding offer, a tax or corporate-structuring opinion, or any indication of what a regulator or lender will decide or how long it will take. Take qualified legal, tax and financial advice before incorporating an entity, signing a facility or committing to a certification timetable.
• You should not rely on any output as the sole basis for a decision. Obtain qualified professional advice before acting.
• Engagement Guarantee: The 3× Year-1 ROI Guarantee applies to commercial engagements with carriers operating 3+ aircraft in scheduled or contract services, subject to Phase 2 data verification.

4. No warranties

The site and tools are provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the tools will be accurate, complete, error-free, uninterrupted, or fit for any particular purpose.

5. Limitation of liability

To the fullest extent permitted by the laws of Kenya, JK, its principals, employees and associates will not be liable for any loss or damage — including any direct, indirect, incidental, consequential or economic loss, loss of profit, or loss arising from business decisions — resulting from your use of, or reliance on, the site, the tools or their outputs. Nothing in these terms excludes liability that cannot lawfully be excluded.

6. Your data and local storage

The tools save your entries in your browser's local storage so you don't lose them on refresh. This data stays on your device and is not transmitted to us. You are responsible for the device and browser you use and for clearing this data if you wish (each tool has a reset/clear control). See our Privacy Notice for full detail.

Because we hold no copy, we cannot recover your work if you clear your site data, lose the device or switch browser. The Venture Control Room can export your whole workspace to a file you save; keeping a backup is your responsibility. That exported file is a readable copy of everything you entered — once you send it to anyone, it is outside our design and outside our control.

7. Intellectual property

The site, its design, text, the JK brand and logo, the scoring methodology, the domain/question framework and the tools are owned by JK or its licensors and are protected by applicable law. You may use the tools for your own internal evaluation purposes. You may not copy, republish, sell, or create derivative works from the content, or remove any proprietary notices, without our prior written permission.

8. Embedding the scorecard

The scorecard is technically embeddable, but framing is restricted by our content-security policy to our own and expressly whitelisted domains. You may embed it only with our permission and only in unaltered form, without misrepresenting it or implying endorsement that has not been given.

9. Acceptable use

• Do not use the site unlawfully or for any unlawful purpose.
• Do not attempt to disrupt, overload, or compromise the site, or to reverse-engineer it to cause harm.
• Do not misrepresent your relationship with JK or pass off the tools or their outputs as your own.
• Do not remove, obscure or alter any notices on the site.

10. Third-party services and links

The site relies on third-party hosting and web-font providers and may link to third-party sites. We are not responsible for the content, availability or practices of third parties. Your use of their services is subject to their own terms.

11. Privacy

Our handling of personal data is described in our Privacy Notice, which forms part of these terms.

12. Changes to these terms

We may update these terms from time to time. The "last updated" date shows the current version; your continued use of the site after changes constitutes acceptance of the updated terms.

13. Governing law and jurisdiction

These terms and any dispute arising out of or in connection with them or the use of the site are governed by the laws of Kenya, and you submit to the exclusive jurisdiction of the courts of Kenya.
